Terms of Service

Agreement

By purchasing, downloading, installing, or using VideoMark, you agree to these Terms of Service with madebybigb. If you do not agree, do not use the software.

Effective date: September 6, 2026.

The product

VideoMark is desktop software for creating type-beat style videos (editor, batch export, metadata helpers, and optional YouTube upload). Features may change between versions.

Purchase is a one-time license fee as listed on Gumroad (currently USD $49 unless a valid offer code applies), not a subscription, unless we clearly state otherwise for a specific offer.

License grant

Subject to these terms and a valid license, we grant you a personal, non-exclusive, non-transferable license to install and use VideoMark on up to three (3) devices that you control.

You may use VideoMark to create videos and related materials for your own music, brand, or clients, including commercial uploads, unless a specific feature’s third-party terms restrict you.

You may not: redistribute, resell, sublicense, or share the app installer or license key; reverse engineer except where law forbids that restriction; circumvent license or device limits; or use the software for unlawful content.

License keys and activation

A valid Gumroad license key is required for full use after any trial or grace period we provide. Activation contacts our license servers and binds devices via fingerprint.

We may suspend or revoke a license for fraud, chargebacks, key sharing, or abuse. Device slots can be managed according to product rules; contacting support may be required to free a slot in some cases.

Updates

Signed updates may be offered through our public releases channel. Installing an update means you accept these terms for the updated software unless a newer terms version is presented.

Third-party services

YouTube, Google, Gumroad, FFmpeg (if used), and other third-party tools have their own terms. You are responsible for complying with them—especially YouTube’s Terms of Service, Community Guidelines, and copyright rules—when you upload or publish.

We are not responsible for Google account bans, Content ID claims, copyright strikes, or platform policy enforcement against your channel or videos.

Your content

You retain rights to your audio, artwork, titles, and other materials. You represent you have the rights needed to use them in VideoMark and to publish resulting videos.

We do not claim ownership of your exports. You grant us no license to your media except as needed to operate features you invoke (for example, sending a file you chose to YouTube’s API).

Disclaimer of warranties

VideoMark is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that exports will meet every platform’s encoding requirements.

Limitation of liability

To the maximum extent permitted by law, madebybigb and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill, arising from your use of VideoMark.

Our total liability for any claim relating to the product is limited to the amount you paid for your VideoMark license in the twelve (12) months before the claim.

Refunds

Refunds are handled under Gumroad’s policies and any statement on the product page at the time of purchase. Unless required by law or Gumroad rules, purchases are generally final.

Termination

Your license ends if you breach these terms or if we revoke it for cause. On termination you must stop using the software and destroy copies in your possession. Sections that by nature should survive (including disclaimers and liability limits) survive termination.

Changes

We may update these terms. Continued use after the effective date of changes constitutes acceptance for ongoing use. Material changes may also be noted on the Gumroad product page or in-app.
